Supreme Court of India Holds Provision for Adultery- Unconstitutional

Supreme Court of India, today, struck down Section 497 of the Indian Penal Code (IPC) which contained the provision for Adultery. The Five Judge Bench were unanimous in holding that the provision treated women as unequal and therefore any law which treats a woman unequally is unconstitutional and violative of Article 14 of the Constitution of India. 

 

The judgments have been penned by four judges separately. While Chief Justice wrote for himself and Justice Khanwilkar, the other judgments were of Justice Nariman, Justice Chandrachud and Justice Ms. Indu Malhotra
