A five judges Bench of Hon'ble Supreme Court of India comprising of Hon’ble Chief Justice of India Deepak Misra, Hon’ble Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan extended the deadline for mandatory linking of Aadhaar to various Government Schemes and bank accounts etc. to March 31, 2018.

The five judges bench in an interim order, also modified its earlier order with regard to linking of Aadhaar with mobile services and said the deadline of February 6 next year for this purpose also stood extended till March 31.

The bench further clarified that for opening new bank accounts; an applicant shall not be required to provide Aadhaar number to the bank. However, the applicant will have to show the proof to the bank that he/she has applied for the Aadhaar number. The interim order was passed based on the submission made by Attorney General Mr. K K Venugopal, who proposed to extend the timeline to March 31, 2018.

Various petitioners have filed petitions before the Hon’ble Supreme Court on the ground that the linking of Aadhaar to Phone numbers and Bank Accounts would amount to infringement of their right to privacy and was also unconstitutional in view of the recent judgment of the Hon’ble Supreme Court of India which held that the right to Privacy is a fundamental right.
