Arbitration and Conciliation

The Arbitration and Conciliation Act, 1996 has been enacted to consolidate and amend the law relating to domestic arbitration, international commercial arbitration and enforcement of foreign awards as also to define the law relating to conciliation and for matters connected therewith.

India has adopted the United Nations Commission on International Trade Law (UNCITRAL) Model Law on International Commercial Arbitration 1985 and UCITRAL Conciliation Rules 1980 while enacting the Arbitration and Conciliation Act, 1996.

The main objects of the Act are as follows:

  1. To comprehensively cover international and commercial arbitration and conciliation as also domestic arbitration and conciliation;
  2. Make provision for an arbitral procedure which is fair, efficient, and capable of meeting the needs of the specific arbitration;
  3. To minimize the supervisory role of the courts n the arbitral process;
  4. Permits Arbitral Tribunal to refer the dispute for mediation, conciliation or other procedure during the arbitral proceedings to encourage settlement of dispute;
  5. To provide that every final award is enforced in the same manner as if it were a decree of the court;
  6. Minimize the grounds of appeal arising out of final award;
  7. To provide that a settlement agreement arising out of conciliation, mediation or any settlement procedure shall have the same status and effect as an arbitral award on agreed terms on the substance of the dispute rendered by an arbitral tribunal;
  8. For purpose of enforcement of foreign award arising out of two conventions namely New York Convention and Geneva Convention.
